Procedure For Filing Ex-officio Notary Documents

Any sheriff department appointing deputies as ex-officio notaries must file the following original documents with the Secretary of State, Notary Division:

1. Letter of appointment according to La.R.S. 33:1464
    a. must be signed by sheriff
    b. must state appointment of certain deputy

2. Oath of office La.R.S. 35:391(7)
    a. must be properly executed
    b. does not need to be filed at parish clerk of court according to La R.S. 35:392(C)

3. Notary Bond La.R.S. 35:391(6)
    a. must be signed by the parish clerk of clerk
    b. members of La. Sheriff's Association's Risk Management Program do not need to provide proof of coverage.

Upon completion of documents you may mail these to:

Baton Rouge, LA 70804

At this point the Secretary of State will commission the deputy an Ex-officio Notary, and issue an ID card.

*REMINDER* - The officer's notarial powers do not begin until he has been commissioned by the Secretary of State. Please wait until the ID card arrives before signing as Ex-officio Notary.
